Terms and Conditions of Sale and Use

1. Purpose
These terms and conditions govern the use of essaouiraexperience.com and the sale of the services offered by Essaouira Experience: leisure activities, excursions, tours, private transfers, airport taxi, car rental and introductions to accommodation and restaurants in Essaouira, Morocco.
Any booking request implies full and unreserved acceptance of these terms.
2. Booking and confirmation
A request sent from the website, by email or via WhatsApp does not constitute a firm booking. The booking becomes final only after our written confirmation stating the service, date, time, number of participants and total price.
We undertake to answer any request within one hour between 7am and 11pm (Morocco time), seven days a week.
3. Prices and payment
Prices shown on the website are in Moroccan dirhams (MAD), all taxes included, per person or per vehicle depending on the service. They are indicative and are confirmed at the time of booking.
Unless stated otherwise, payment is made on site, in cash or by card depending on the provider. No banking data is requested or stored by the website.
4. Cancellation and changes
Any booking may be cancelled free of charge up to 24 hours before the service begins. After that, or in case of no-show, the service may be charged in full.
We reserve the right to cancel or postpone a service for safety reasons, in particular in adverse weather conditions. In that case an alternative date is offered or any amount already paid is refunded in full.
5. Customer obligations
The customer undertakes to arrive at the agreed place and time, to follow the safety instructions given by the staff and to declare any medical condition that could affect their participation (pregnancy, heart condition, recent injury, etc.).
Minors must be accompanied by a responsible adult. Some activities have a minimum age stated on their page.
6. Insurance and liability
Our providers hold the insurance required by Moroccan regulations for their activity. It nevertheless remains the customerβs responsibility to take out travel insurance covering the sports and leisure activities practised.
We cannot be held liable in the event of force majeure, the act of a third party, or the customerβs failure to follow safety instructions.
7. Role as intermediary
For accommodation and restaurants, Essaouira Experience acts as an intermediary: the accommodation or catering contract is concluded directly between the customer and the establishment, which remains solely responsible for its service.
8. Intellectual property
All texts, photographs, logos and graphic elements on the website are protected. Any reproduction, even partial, without prior written permission is prohibited.
9. Complaints
Any complaint must be sent to us within 30 days of the service, by email to contact@essaouiraexperience.com, quoting the booking reference. We undertake to reply within 7 working days.
10. Governing law
These terms are governed by Moroccan law. Failing an amicable settlement, the competent courts of Essaouira shall have exclusive jurisdiction.
